Such merchants may, at any time and from time to time, make changes to their websites that prevent Upshelf from accessing such websites or extracting data therefrom, and Upshelf has no liability for any failure to provide the Services by reason of any such change in a merchant’s website.

Upshelf does not guarantee that access to or use of the Site or the Service will be uninterrupted or error-free, or that the Site or Services will be free from viruses or other malicious code.
Limitation of Liability
Upshelf’s liability for the Services is limited in accordance with the provisions of the applicable Agreement. EXCEPT AS EXPRESSLY PROVIDED IN THE AGREEMENT, IN NO EVENT WILL UPSHELF OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SITE, THE SERVICES OR THE CONTENT AVAILABLE THROUGH THE SITE OR SERVICES, OR ANY OTHER WEBSITE THAT MAY BE ACCESSED THROUGH THE SITE.
